What is an Estate?

An estate is the total of all the assets someone owns and all of the liabilities they owe at the time of their death. This includes absolutely everything you can think of, ranging from cash and real estate to business interests and intellectual property.

What Happens to an Estate After Death?

When someone dies, their estate goes through a process of managing its debts and distributing its assets. There are two type of estates – Probate and Trust Administrations. An executor or a trustee is responsible for managing the estate and paying any of the estate’s debts. They then pay any legal or other bills incurred during the process. Finally, the remaining assets are distributed among the appropriate beneficiaries. Once complete, the estate ceases to exist.

What is Probate?

Probate is the legal process during which the court ensures that debts are paid and assets are distributed according to your loved one’s Will. If they don’t have a valid Will, the assets are distributed according to state law. The court oversees the distribution of assets from the estate according to the Will or state law. This process is called the “administration” of the estate, and it is overseen by an executor, who is appointed by the probate judge.

Any assets that have beneficiary designations will pass outside of probate unless left to a minor. These assets are not controlled by a Will. This process can be expected to take 6-12 months in Georgia, if uncontested and straight forward.
